Definitions:
The terms “user”, “you” and “your” refer to the individual or organization that creates an ASK (Answers 4 Special Kids) account. “ASK” “we,” and “our” will refer to ASK. ”Terms” or “TOS” refer to the terms contained in this Agreement. “Customer” will be used to describe the person who asks questions on this Site. “Expert” will be used to describe the person who answers questions on this Site.
Accounts:
As a “user”, you represent that you are authorized to create and access an account. Through the user process, you will establish a user name and password for access to your online account. You are responsible for maintaining the confidentiality of your user name, account data and password.
Any content provided by you on the Site (including any questions asked or answered), and your use of our service, shall not be fraudulent, inaccurate or misleading.
Fees:
You choose the price option that is described on the Site by choosing a short or long question. Fees are all handled through Paypal accounts only.
Refunds will only be made in two instances. One being if your question is out of the scope of practice and/or the intent of this Site. The ASK action would be to refund your money and direct you back to your medical practitioner. The second instance would be if questions asked were inappropriate. The Customer would be refunded his/her money and blocked from using this Site.
Warranties:
ASK documentation is provided “as is”, without any warranty of any kind either expressed or implied. No oral or written information obtained by you, from us, through this Site, shall create any warranty, representation or guarantee not expressly stated in these terms. ASK does not represent or warrant that the service will be uninterrupted or error-free, that defects will be corrected, or that this Site, or the server that makes it available, are free of viruses or other harmful components.
No relationship with users:
Placement of information, logos, links or names of non-ASK entities on the ASK Site does not constitute an endorsement or warranty of these entities, their products or services. Users take full responsibility for a decision to visit or patronize any such entity and holds ASK harmless from any liability arising from such actions.
IT IS THE RESPONSILILITY OF THE USER TO EVALUATE THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY OPINION, ADVICE OR OTHER CONTENT AVAILABLE THROUGH THE SITE, FROM THIRD PARTIES OR OBTAINED FROM A LINKED SITE. Proprietary Rights of Content:
You agree that any content or information imported to this Site, whether a question or answer, will not be considered confidential and may be used by ASK in its sole discretion, without any obligation to compensate for its use of the ideas, and without any obligation to return any submitted materials. You herby grant ASK a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise the copyright, publicity, and database rights, including the right to create derivative works thereof, that you have in your content and information, in any media now known or currently known, with respect to any such content or information.
Any identifying information will not be revealed.
If you use a Public Area, such as a chat room, blog, or message boards through ASK, you are solely responsible for your own communications, the consequences of posting those communications, and reliance on any communications found in the Public Areas. ASK is not responsible for the consequences of any communications in the Public Areas.
In consideration of being allowed to use the Public Areas, you agree that the following actions shall constitute a material breach of these Terms and Conditions:
- Using a Public Area for any purpose in violation of local, state, national, or international laws.
- Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others.
- Posting material that is unlawful, obscene, pornographic, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by ASK in its sole discretion.
- Posting advertisements or solicitations of business or funds.
- After receiving a warning, continuing to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form).
- Posting chain letters or pyramid schemes.
- Impersonating another person.
- Distributing viruses or other harmful computer code.
- Harvesting or otherwise collecting information about others, including email addresses, without their identification for posting or viewing comments; consent; posting the same note more than once, or “spamming”.
- Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Area, in which in the judgment of ASK, exposes ASK or any of its customers to any liability or detriment of any type.
ASK reserves the right (but is not obligated) to do any or all of the following:
Investigate an allegation that a communication(s) do(es) not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication(s).
Remove communications that are abusive, illegal, or disruptive, or that otherwise fail to conform with these Terms and Conditions.
Terminate a user’s access to any or all Public Areas and/or the ASK Site upon any breach of these Terms and Conditions.
Monitor, edit, or disclose any communication in the Public Areas.
ASK or its licensors have no liability or responsibility to user of the ASK Site or any other person or entity for performance or nonperformance of the aforementioned activities.
General:
ASK is based in Salem/Dallas Oregon, in the United States of America. If you access the ASK Site from outside the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.
BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS ASK FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ASK DURING OR AS A RESULT OF ITS INVESTIGTATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER ASK OR LAW ENFORCEMENT AUTHORITIES.
